Terms & Conditions of Sale

These Terms & Conditions are governed by the Consumer Protection Act 68 of 2008 (CPA), the Electronic Communications and Transactions Act 25 of 2002 (ECTA), and POPIA. Your statutory rights as a consumer are not affected by anything in these terms.

1. Who We Are

shelvingstore.co.za is operated by Fettlen Group (Pty) Ltd, registered in the Republic of South Africa. Our offices are located at 1692 Hermansburg Rd, Stonehenge, Nelspruit, Mpumalanga 1200. Contact us at info@shelvingstore.co.za or +27 (0)87-630-1800.

2. Definitions

  • "Buyer" / "You" — any person, sole trader, partnership, business, body corporate, or other entity listed on a sales invoice or order form, including all successors and assigns. Where you act as a consumer, your statutory rights remain unaffected.
  • "Goods" — the items listed on the sales invoice or order form. Ancillary items are excluded unless specifically listed.
  • "Price" — the total amount payable for the Goods and, where applicable, delivery services.

3. Pricing

Prices are subject to change and will be confirmed at the time of order. Orders placed via our website are only accepted once confirmed in writing by us.

ECTA s. 43: The full price, including all fees, must be disclosed before the consumer is bound.

4. Product Brands

Product brands advertised on our site may vary due to availability. We will never compromise on quality and will ensure any alternative brand supplied is of equivalent quality and specification to the one advertised.

5. How These Terms Apply

These terms apply to all quotations, orders (including telephone orders), and contracts for the supply of Goods. For trade buyers, all other representations — whether statutory, collateral, or subsequent — are excluded unless expressly agreed to in writing.

6. Order Accuracy

You are responsible for ensuring all order details are correct. We accept no liability for errors resulting from inaccurate information you provide. We reserve the right to correct technical or clerical errors in an order.

7. The Order Process

  • After placing an order, you will receive an Order Acknowledgement email confirming receipt. This does not constitute acceptance of your order.
  • Acceptance occurs when we send you an Order Confirmation detailing your order and expected dispatch or delivery dates.
  • The contract covers only the Goods listed in the Order Confirmation.

ECTA s. 22 & 23: A contract concluded electronically is only binding once both parties have completed offer and acceptance. The Order Confirmation constitutes our acceptance.

8. Entire Agreement

These terms, together with our current prices, delivery details, contact information, and the following linked policies, form the entire agreement between us:

  • Returns & Refund Policy
  • Shipping & Delivery Policy
  • Privacy Policy
  • Cookie Policy
  • Installation Policy (where installation is included in your order)

Statements made by our staff do not constitute variations or warranties unless expressly confirmed in writing.

9. Pricing Errors

If a pricing error is discovered after your order is placed, we will contact you to confirm the correct price or cancel the order. If we cannot reach you, the order will be cancelled and any payment refunded in full.

CPA s. 23: A price displayed incorrectly does not bind the supplier if the error is brought to the consumer's attention before the transaction is completed.

10. Weight Limits

Maximum shelf, tier, and deck weight ratings refer to evenly distributed loads only. We do not exchange shelves, tiers, or decks that have been bent, buckled, or damaged due to overloading or misuse.

11. Our Right to Cancel

We may cancel your order if:

  • Insufficient stock is available.
  • We cannot deliver to your area.
  • A pricing error has occurred.
  • Fraudulent activity is suspected.

If we cancel your order, we will notify you by email and refund any payment received within 14 days. No additional compensation will be payable.

CPA s. 47: Suppliers must refund consumers in full if an order is cancelled by the supplier.

12. Changes to These Terms

We may update these terms at any time. Changes are legally binding once published on our website. We recommend reviewing this page periodically. The version in force at the time of your order governs that transaction.

CPA s. 49: Material changes that limit consumer rights must be brought to the consumer's attention in a manner likely to be noticed.

13. Governing Law

These terms are governed by the laws of the Republic of South Africa. All disputes are subject to the jurisdiction of the South African courts.

Trade Disputes (Business-to-Business): The parties consent to the jurisdiction of the Magistrate's Court of Nelspruit in respect of any proceedings arising from this agreement, provided that this shall not preclude the seller from instituting proceedings in any other court of competent jurisdiction.

Consumer Disputes: Where you are a Consumer as defined in these terms, this jurisdictional clause does not limit your right to approach any court of competent jurisdiction, nor your right to refer a dispute to the National Consumer Commission (NCC), the Consumer Goods and Services Ombud (CGSO), or the National Consumer Tribunal as provided for under the CPA.
